Barring a last minute reprieve by Gov. Eric Greitens or the U.S. Supreme Court, Marcellus Williams will be executed on Tuesday. Had he received a fair trial, jurors almost certainly would have found enough reasonable doubt not to return a verdict that would trigger capital punishment. Because substantial reasonable doubt remains, Williams deserves to be spared death. His victim, our former colleague, would have wanted it that way.
Last week, on the day he was scheduled to die, Marcellus Williams didn’t.
The five judges will help determine whether Marcellus Williams will live or die.
